Terms of Service

These Terms of Service ("Terms") govern your use of Mailara, an AI-powered email assistant service including the Outlook Add-in and web application at app.mailara.ai, operated by Mailara ("we", "us", or "our").

By accessing or using Mailara, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. The Service

Mailara provides an AI-powered email analysis and drafting assistant that integrates with Microsoft Outlook. The service includes email summarization, priority classification, reply drafting, and related features as described on our website.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use Mailara. By using the service, you represent that you meet these requirements.

The Mailara Outlook Add-in requires a Microsoft 365 work or school account. Personal Microsoft accounts may use the Mailara Web App.

3. Account

You sign in to Mailara using your Microsoft account via OAuth2. You are responsible for maintaining the security of your Microsoft credentials. You must notify us immediately at info@mailara.ai if you become aware of any unauthorized use of your account.

4. Subscription Plans and Payment

4.1 Plans

Mailara offers a Free plan and paid subscription plans (Pro DeepSeek, Pro, Enterprise). Plan features and pricing are described at mailara.ai and may be updated from time to time.

4.2 Free Trial Period

All new accounts receive 30 days of unrestricted access at no charge and with no credit card required. This allows you to experience the full capabilities of Mailara before deciding on a plan. After 30 days, your account automatically switches to the Free plan (20 emails/day). You may upgrade to Pro or Pro DeepSeek at any time to remove usage limits.

4.3 Billing

Paid subscriptions are billed monthly or annually in advance. All payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis until you cancel.

4.4 Cancellation

You may cancel your subscription at any time through the customer billing portal. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

4.5 Price Changes

We reserve the right to change subscription prices with at least 30 days' notice. Continued use of the service after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to use Mailara to:

Violate any applicable law or regulation
Send or process content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Infringe on the intellectual property rights of others
Attempt to reverse engineer, decompile, or disassemble any part of the service
Use automated tools, scripts, or bots to access the service in a manner that exceeds normal human usage
Resell or sublicense access to the service without our written permission
Attempt to gain unauthorized access to our systems or other users' accounts

5.1 User Responsibility for Content

You are solely responsible for all content you submit to Mailara for processing. Mailara acts as a conduit — transmitting your email content to AI model providers for analysis and returning the result. We do not review, monitor, or moderate the content of emails you submit. By using the service, you represent that your use complies with all applicable laws and that you have the right to process the email content you submit.

5.2 AI Provider Content Policies

Email content submitted for analysis is processed by third-party AI model providers (such as DeepSeek or OpenAI). These providers maintain their own content policies and may refuse to process certain content. Mailara is not responsible for any refusal or filtering applied by AI providers. You are encouraged to review the terms and content policies of the applicable AI provider.

6. AI-Generated Content

Mailara uses third-party AI models to generate email summaries and reply drafts. You acknowledge that:

AI-generated content may contain errors, inaccuracies, or inappropriate suggestions
You are solely responsible for reviewing and approving any AI-generated content before sending
Mailara is not liable for any consequences arising from your use of AI-generated content
The quality and availability of AI-generated content depends on the availability and performance of third-party AI providers, which may change without notice

7. Intellectual Property

The Mailara service, including its software, design, and content, is owned by Mailara and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service for your personal or internal business purposes in accordance with these Terms.

You retain all rights to your email content. By using the service, you grant Mailara a temporary, limited license to process your email content solely for the purpose of providing the AI analysis service.

8. Privacy

Your use of Mailara is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAILARA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO MAILARA IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mailara and its affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your use of the service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our sole discretion, with or without notice. Upon termination, your right to use the service ceases immediately.

You may delete your account at any time by contacting info@mailara.ai.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date. Continued use of the service after changes constitutes acceptance.

15. Fair Use Policy

Paid plans offer unlimited email analysis for normal business use. "Unlimited" means we do not impose a fixed daily cap on the number of emails analyzed by human users in the course of regular work. It does not authorize automated, scripted, or bulk processing that exceeds what a human user could reasonably perform.

To protect service quality for all users, we apply rate limiting at the API level. Accounts exhibiting usage patterns consistent with automation or abuse — such as sustained high-frequency requests significantly exceeding normal human interaction rates — may be rate-limited, suspended, or terminated at our discretion. We will make reasonable efforts to notify affected users before taking action, except where immediate action is required to protect the service.
